Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the TerraConnect website and services operated by Ex Terra Novo (“Company,” “we,” “our,” or “us”).

By accessing or using TerraConnect, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

Description of Service

TerraConnect is a platform designed to connect Saskatchewan landowners with outdoor enthusiasts seeking legal access to private land. We facilitate the connection between parties but are not a party to any agreements made between landowners and land users.

Note: TerraConnect is currently in pre-launch phase. By registering your interest, you are joining our waitlist to be notified when the platform launches.

User Accounts

To use certain features of TerraConnect, you may be required to create an account. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

User Responsibilities

All Users

You agree not to:

• Use the platform for any unlawful purpose
• Provide false or misleading information
• Interfere with or disrupt the platform or servers
• Attempt to gain unauthorized access to any part of the platform
• Use the platform to harass, abuse, or harm others
• Violate any applicable laws or regulations

For Landowners

As a landowner, you additionally agree to:

• Only list land that you own or have authority to grant access to
• Provide accurate information about your property
• Clearly communicate rules, restrictions, and expectations
• Honor confirmed access agreements
• Maintain appropriate insurance coverage for your property

For Land Users

As a land user, you additionally agree to:

• Comply with all applicable laws, including Saskatchewan's Trespass Act and The Wildlife Act, 1998
• Respect the landowner's property and rules
• Only access land during agreed-upon times
• Leave the property in the condition you found it
• Hold all required licenses and permits for your activities

Platform Role and Limitations

TerraConnect acts as a facilitator to connect landowners and land users. We:

• Are not a party to agreements between landowners and land users
• Do not guarantee the accuracy of listings or user information
• Do not guarantee the safety or condition of any property
• Do not provide legal, insurance, or professional advice
• Are not responsible for disputes between users

Intellectual Property

The TerraConnect platform, including its content, features, and functionality, is owned by Ex Terra Novo and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Disclaimer of Warranties

TERRACONNECT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EX TERRA NOVO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF TERRACONNECT.

Indemnification

You agree to indemnify and hold harmless Ex Terra Novo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the platform or violation of these Terms.

Termination

We may terminate or suspend your access to TerraConnect at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the platform will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the “Last updated” date and, where appropriate, provide additional notice. Your continued use of TerraConnect after changes constitutes acceptance of the modified Terms.
